A number of people have asked about making a donation to help run this site. I'm not interested in that at all. But if you do want to make a contribution then I support a local Charity called Spirit of the Dog who are crying out for funds you can donate on-line via paypal.
It's fairly simple to make a claim, use the moneyclaim online
service at www.moneyclaim.gov.uk Make sure you put the defendent as Clode Funding Limited (check your loan agreement papers to see who the agreement is with, if in doubt, make the claim against Clode Funding Limited and Clode Retail Finance Limited. The only difficult part of the procedure is putting in the reason for the claim, I used something like for Breach of contract including but not limited to:-- Failure to give notice of the contract change and its details and allowing you the opportunity to reject it.
- Failure to notify you of your consumer protection rights at the time of the change.
- Providing a lesser and degraded service.
- Instituting a cap and blockage on your broadband connection and access when your contract was for unlimited and uncapped service.
- Failing to provide you with a service for a number of days in the month following their application of a cap on the service.
- Failing to provide any information on any of their proposed changes yet giving public statements to the press which outline a detrimental service.
- Failing to provide reasonable duty and care in the provision of a service to you.
I put in my claim for the total balance of my Clode account, plus the last 2 months disrupted service plus cost of phone calls letters etc. The moneyclaim website automatically add the court costs to the claim. Once submitted the claim is then served to Clode and they then have 14 days to acknowledge the notice. they then have a further 28 days to file a defense. After this you then get the option of which Court you want them to appear in. By default it will be your local court. (Make them travel as far as possible, it's not cheap to have a lawyer travel half way across the country.)
